SHORT-TERM RENTAL TERMS AND CONDITIONS

 

AGREEMENT BETWEEN PARTIES:

This short-term rental agreement (“Agreement”) is by and between (our company name provided after booking) for the Owner of the vacation rental property (“Owner”) and the renter of the short-term vacation rental (“Guest”) who is solely responsible for the actions of their family, invitees, and guests. The Guest is required to complete a Guest Registration process (page 11 of this agreement) that will bind all Registered Guests to this Agreement. Any individual that provides any payment toward the reservation must be listed as a Registered Guest and is bound to this Agreement, regardless of whether they intend to occupy the Vacation Rental. The Guest hereby rents from (our company name provided after booking) the reserved property (“Vacation Rental”) on a short-term basis (of less than 30 days). The Vacation Rental shall be used for single-family residential purposes exclusively by Guests. Only Registered Guests are permitted to use, occupy, or visit the Vacation Rental and/or common areas or amenities, including but not limited to the property, pool facilities, front yard, garage, and driveway. Individual(s) that are NOT Registered Guests are strictly prohibited from any type of use of the Vacation Rental and surrounding amenities as noted herein. Breach of this policy may result in fines and/or eviction.

The minimum age requirement for the Guest submitting payment to reserve the Vacation Rentals is 25 years of age. Guests less than 25 years of age must be accompanied at all times during their stay by a Guest that meets the minimum age requirement. Pacific Legacy Real Estate reserves the right to refuse service to anyone in accordance with all applicable laws.

Except as required by California law, (our company name provided after booking) shall not be liable for non-delivery or mis-delivery of services provided herein, nor shall this Agreement be terminated for any interruption of, or interference with, services or accommodations due to Guest, caused by circumstances beyond (our company name provided after booking) reasonable control, including but not limited to: weather conditions, labor strikes, civil unrest, government orders, acts of other guests, acts of God, Force Majeure events, pandemics, accidents, necessary repairs to the property, or any other similar causes, except as specifically outlined in this Agreement.

The Guest(s) hereby agree(s) to hold (our company name provided after booking) harmless against losses, deficiency, and/or any inconveniences caused by unexpected interruptions of use of the Vacation Rental to accommodate scheduled Guests. If such an incident occurs, (our company name after booking) is not liable for any indirect financial or scheduling burden including but not limited to airlines reservations, rental car reservations, pre-paid event tickets, etc. 

Falsified Reservations: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money and the party will not be permitted to check-in, if already checked-in all guests will be removed from the premises. Any fraudulent activity, false claims, falsifying your contract, failure to compensate (including bounced checks, identity theft, etc.) will result in immediate removal and forfeiture. Additionally: fees, legal avenues and attorney fees may be sought from you.

Third Party Booking Sites Service Fees: Some third-party booking sites (i.e. HomeAway, VRBO, Airbnb, etc.) assist in matching (our company name provided after booking) and Guest and may collect Booking or Service fees as part of a reservation process. Booking or Service fees paid by Guests to third-party booking sites are not covered by this agreement and (our company name provided after booking) is not responsible for collecting or refunding those fees or for any service provided for that fee. Third-party booking sites are not a party to this agreement, even if Guest pays the rental amount through a third-party booking site.

Third Party Booking Site Policy Display Conflicts (VRBO, Airbnb, etc.) Pacific Legacy Real Estate’s Rental Terms and Conditions herein supersede, without exception, all other terms/conditions displayed on or by a third-party listing site (i.e. VRBO, Airbnb, Booking.com, etc.) that may conflict with the policies listed herein. (our company name provided after booking) will make every possible effort to ensure that listing sites display (our company name provided after booking) Terms and Conditions exactly how they read herein, however third party listing sites often have system/design limitations impacting the information we display and/or worse confusingly display their own policies that do not adhere to our own. A copy of (our company name provided after booking) Terms and Conditions herein are provided on every third-party listing site as technologically possible, 

1. CANCELLATIONS, NO SHOWS, CHANGES & REFUNDS

A written notice (email OK) is required for all cancellations or shortening of stay. Must be submitted in writing and receipt confirmed by ladonnafranke@gmail.com . Cancellations made more than 60 days prior to the arrival date will be fully refunded. We allow cancellation without penalty for at least 24 hours after the reservation is confirmed if the cancellation is made at least 72 hours before check-in time per California State Law. Cancellations or changes made within 60 days of the arrival date forfeit the full advance payment and reservation deposit. This includes modifications that result in a shortened stay. Late Arrival and Early departure do not warrant any refund of monies paid. Subject to applicable California law and regulations, no refunds will be provided for cancellations due to Guest’s inability to travel, event cancellations, Disneyland closures, weather conditions, natural disasters, earthquakes, pandemics, acts of God, force majeure events, or any other circumstances outside of (our company name provided after booking) direct control, unless otherwise required by law. Guest acknowledges and accepts this risk by entering into this Agreement. We highly recommend you Purchase CFAR (Cancel for ANY Reason) travel insurance to cover such circumstances. This can be purchased separately from any company you choose. In case of human error on our part that necessitates cancellation, and a remedy solution cannot be agreed upon by both parties, any monies paid for unused days will be refunded. No other accommodations or compensation will be made. Any increase in guest count after the reservation has been confirmed must be immediately communicated in writing (email ok) to (our company name provided after booking)  for re-approval. An increase in guest count is subject to our Cancellation Policy herein if the new guest count exceeds adult and/or total occupancy limits or fails to meet any of our Terms and Conditions. Pacific Legacy Real Estate strongly recommends Guest’s confirm and provide their final guest count at the time of original booking to avoid any potential issues that may arise including additional fees and cancellation.

2. TRAVEL INSURANCE (our company name provided after booking) strongly recommends you purchase third party Vacation Rental Insurance to protect and mitigate your potential losses. Vacation Rental Insurance can provide coverage for prepaid, nonrefundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses.  Some also include your group’s ability to travel to the home. You are solely responsible for any and all expenses associated with this agreement, including: (Travel, Airfare, Amusement park tickets, Purchases, etc.) We will not be liable for any expenses related to your agreement. If you wish to purchase travel insurance, here are some companies you may wish to look at: www.insuremytrip.com, www.anaheimvacation.rentalguardian.com, www.travelsafe.com, www.tripassure.com, www.travelguard.com, or check with your booking platform. Contact these companies directly for details on coverages offered and how to purchase. It is your responsibility to research the type of coverage you need to protect your travel reservation. We are not responsible for your inability to travel. In the event of a mechanical or plumbing failure, the owner will make every attempt to remedy the situation in a timely manner. However, we will not pay for other accommodations while the problem is being fixed. Should the home become damaged prior to your arrival (due to fire, flood, earthquake, or any other unforeseen reason), any monies paid will be promptly returned. No other accommodation will be made.  I understand the risk and responsibility if I choose not to purchase travel insurance.  I agree that all rental monies within 60 days of arrival are non-refundable according to the cancellation policy above. I have read my rights to purchase travel insurance. By Signing Below, I agree to all terms and conditions of this cancellation policy.

3. FAILURE TO CHECK-OUT ON TIME

Check-in (after 4pm) and check-out (by 10 am) times are firm and as stated in this agreement. If you do not depart by 10 am: After providing reasonable notice, the owner or manager may enter the property, along with the cleaning service, to prepare the home for the next guest. Any personal belongings will be handled in accordance with California law regarding abandoned property. Additional charges of $50/hour will apply. Our cleaning service arrives promptly at your check-out time on the day of departure. They will enter at 5 minutes past check-out time. Extra cleaning is billed at $50/hour.

4. ITEMS LEFT BEHIND: (our company name provided after booking) cannot be held responsible for personal items left behind by Guests.  If items are found, (our company name provided after booking, at Guests’ request, will mail items(s) to Guest for a $25/handling fee plus the actual cost of shipping. 

5. SECURITY DEPOSITS, ACCIDENTAL DAMAGE PROTECTION, EXCESSIVE TRASH, & OTHER CHARGES/FEES:

Security Deposits: If a security deposit is collected, (our company name provided after booking) will return the deposit to Guest within 14 business days after (our company name provided after booking) has inspected the property. (our company name provided after booking) shall apply the deposit as necessary against the cost of restoring the unit to the condition when Guest arrived, allowing for normal wear and tear.

Accidental Damage Fee: Guest has paid a non-refundable damage fee of $79.00 per property (Included in booking platform pricing). This fee covers up to $3,000 of accidental or unintentional physical damage caused by guests. In the event of damage to the unit exceeds the covered maximum, guests agree to pay additional cost associated with damage. The Damage fee DOES NOT cover costs associated with any intentional damage, negligence by guests, or pet damage. Guest must notify (our company name provided after booking) in writing (email acceptable) within 24 hours of any damage incident occurring, otherwise Guest will be responsible for all damages regardless of cause or coverage limits.

Damages to Rental Property:

Guest agrees to promptly notify (our company name provided after booking) of any damages or accidents that occur to both real and personal property during their stay. If (our company name provided after booking) determines that the damage or accident did not result from intentional, wanton, or willful misconduct, (our company name provided after booking) will repair or replace the damaged property as needed, up to the maximum accidental damage coverage amount of $[AMOUNT]. Any damage or accident that exceeds the maximum covered amount is the responsibility of the Guest. Damages must be reported immediately to allow (our company name provided after booking) to make necessary repairs. Failure to report damages promptly will result in the Guest being held responsible for all damage costs. Pet damage (pets are not allowed) and damage resulting from smoking are the sole responsibility of the Guest.

Homeowners Association fines or City Violations: or fines of any amount will be the responsibility of the guest. 

Excessive Trash: Excessive Trash is defined as more trash than will fit into the available trash cans onsite which are designed to accommodate reasonable trash volume for the maximum number of guests allowed. Excessive trash in/on property must either be cleaned up and removed by Guest prior to departure or (our company name provided after booking) will be forced to remove excessive trash on behalf of Guest at a cost of $50/hour to cover the time, expense, and applicable dump fees for doing so. 

Dirty Dishes: Soiled dishes are to be placed in the dishwasher and cleaned. (not necessary to put away)

Towels & Linens:  All pool towels are to be washed prior to departure (they can be left in dryer) – Fee if not done.  Leave beds unmade and start your bath towels in the washer on way out.  Stained bedding & towels will be charged at replacement cost.

BBQ: If the BBQ was used, it is scraped clean. **Do not try and move BBQ, you will break the natural gas line and you will be liable for all damages and it could start a fire**.

Missing TV Remotes ($100 ea.): TV Remotes are to be left in basket (labelled remotes) in main living area. 

Other Charges/Fees: (our company name provided after booking) may charge fees for additional services including but not limited to: Early check-in/late check out ($25/hr.), Additional Pool Heating ($10/per degree x number of days), and other services as disclosed to Guest.. Any and all fee(s) will be disclosed to the Guest either at the time of booking when service is rendered, and/or at the time a Guest purchases an additional product or service from (our company name provided after booking). 

  6. GENERAL (our company name provided after booking) – VACATION RENTAL RULES:

Property Specific Short Term Rental Information and Rules: Guest agrees to comply with all property specific rules: Guest agrees to follow all (city you are booking in) Ordinance for Short Term Rentals these rules are substantial different than their ordinance/rules for full-time residents. Any validated complaints and/or violations of the (city you are booking in) Ordinance may result in a fine up to $2,500 plus reinspection fees and/or eviction. 

Good Neighbor Policy: (our company name provided after booking)  homes are designed for families and friends to peacefully enjoy their stay. (our company name provided after booking) does not tolerate any partying, loud noise, exceeding occupancy limits, illegal parking, etc. that violate policy or interfere with our neighbor’s peaceful enjoyment of their community. The Good Neighbor policy aligns with the city’s short-term rental ordinance and applies to ALL vacation rentals, not just (our company name provided after booking) – Vacation Rentals. Please be respectful of our long-term residents and our community. We are mandated to provide our neighbors with our phone numbers, and they are aware of the city and house rules stated in this agreement.  Please DO NOT knock on their doors to ask for information and respect their privacy.  While walking through our neighborhoods please DO NOT toss cigarette butts or other trash onto resident’s property. Please behave and respect these neighborhoods the way you would if this was your home.  

City Rules/Violations/Fines: The Owner and/or the Management Company or its Private Security Company/Officers and its affiliates will have the right to immediately enter the property and permanently remove renters from the property and retain all moneys paid (renters will forfeit) – if any of the following violations occur and/or city regulations are broken:

  • City Ordinances All city ordinances and any subsequent changes to them will supersede the city rules in this agreement.
  • Exceeding Maximum Occupancy:   MAXIMUM OCCUPANCY of this property is strictly limited to (total number of guest in your specific listing) at any time, which includes both overnight guests and daytime visitors. NO ADDITIONAL VISITORS or GUESTS beyond this total are permitted on the property or in the home at any time. Violation of occupancy limits will result in immediate termination of the rental agreement and forfeiture of all payments. ONLY Registered Guests (on guest list) are permitted to use, occupy, or visit the Vacation Rental and/or common areas or amenities, including but not limited to the property, pool, facilities, front yard, garage, and driveway. 
  • The City of (city you are renting in) mandates a strict Quiet Time between 10pm to 9 am. Prohibited Outdoor Activity period from 10:00 p.m. to 9:00 nightly. During these hours, the use of the pool, patio, front yard, game room/garage, and all outdoor areas is strictly prohibited. All conversations must be moved indoors by 10:00 p.m. sharp. Violations of this rule are charged at $2,500.00/occurrence. If the authorities are called out, you will be responsible for this fine and will be removed permanently from the property without any refund. THERE WILL BE ZERO TOLERANCE ON THIS ISSUE**.  The City of (city you are renting in) has provided neighbors with a Vacation Rental Hotline for filing complaints, and local code enforcement operates 24/7 to ensure compliance with Quiet Time, occupancy, and parking regulations. Failure to adhere to these rules may result in neighbors filing formal complaints with (our company name provided after booking) and/or the Police/Local authorities.
  • PARKING/MAXIMUM VECHICLES/ELECTRIC VEHICLES (NO STREET PARKING is allowed) Maximum Vehicles allowed are per your individual listing.  (If your cars block the sidewalk or are otherwise illegally parked you will be ticketed and towed).  We are not responsible for any fines or fees incurred to the renter or renter’s guests; it’s your responsibility to inform all of your guests of the rules.    Electric vehicles may NOT be charged on our property. Violators will forfeit their security deposit. (NO Commercial Vehicles, NO RV’s, NO Trailers, NO Loud Motorcycles, NO Exceptions).
  • No Parties or Business Activity: The rental property is to be used exclusively for overnight lodging accommodations. The property may not be used for weddings, receptions, rehearsal dinners, parties, bachelor/bachelorette gatherings, conferences, corporate events, business dinners, cocktail parties, or any similar activities.
  • General Noise: No outside music is allowed at anytime and no loud and unreasonable noise is permitted during daytime hours.  It is a violation for any person(s) to cause disruptions to neighbors or neighborhood.
  • If any person related to renting party or guests is found to be causing harm to the property, everyone will be removed from premises without a refund.
  • Guest(s) are responsible for paying any or all fines given by the city and (our company name provided after booking) reserves the right to terminate the rental agreement and immediately evict the person responsible or all occupants upon any violation. 
  • The city has hired extra police to patrol and enforce these rules 24/7.

Care of Vacation Rental: Guest will keep the Vacation Rental in clean and sanitary condition and dispose of all garbage waste in appropriate Trash Containers. Guests shall report any plumbing or electrical or dangerous condition/problem immediately to (our company name provided after booking). Guests will not deface or damage the Vacation Rental or its amenities in any way and will inform (our company name provided after booking) promptly of any damage caused by Guests and is responsible for damages beyond normal wear and tear. In addition, Guests shall be responsible for any expense or damage caused by stoppage of waste pipes, garbage disposal, or overflows from bathtubs, toilets or washbasins or sinks if due to Guest’s neglect or misuse. Guests shall not store gasoline, cleaning solvents or any other combustibles in the Vacation Rental, garages, or any other part of the property and/or common areas.

NO PETS are allowed on the property. (See service animal disclosure below) This means inside the house or on the property outside of the home. If there is evidence of pets, animals, etc. found during or after your stay you will be charged a $500 fine for extra cleaning and remediation to remove pet odors/dander, residues, etc. from home. We advertise as a pet free home. There are guests who specifically rent from us to ensure that they will not be affected by pet allergies and asthmas related conditions. There is a considerable cost to clean a home to bring to this standard. If you break this rule, you will be responsible for all costs associated with this deep clean. Guest must advise (our company name provided after booking) of any service animals at the time of booking and provide relevant documentation (rabies vaccine & flea dip) and disclose service animal provides to its owner. Service animals are to be with their owner at all times and may not be left alone at the home. (our company name provided after booking) reserves the right to decline reservations that include animals in accordance with the Americans with Disabilities Act (ADA) and applicable state laws regarding service animals and emotional support animals.  

Keys & Keyless Entry: Upon departure all doors to home are to be locked.  Our doors DO NOT SELF LOCK.  Please enter your code plus the checkmark button (WAIT until you hear the door lock, then check to make sure its locked). All codes expire at 10 am on the day of departure. Please leave keys to any other doors in their locks. 

Guest Behavior: No unusual or loud noise is permitted at any time day or night. Music, stereos, radios, televisions, etc. must be turned down low enough so as not to be heard outside the Vacation Rental or through common walls, windows, or between neighboring patios. Intoxication or excessive use of alcoholic beverages, marijuana, the use of illegal substances, disorderly conduct, unnecessary and/or objectionable noise, reckless driving in the neighborhood or complex roads or driveway(s) is strictly prohibited. Guests shall not use, keep, or have in their possession any illegal firearms, drugs, fireworks, or other illegal substances. No Guest Alteration to Property: Guest will not alter the Vacation Rental in any way (i.e. moving beds, no moving furniture or using nails, screws, tape, tacks, paint, etc. on walls, ceilings, floors, fencing, stucco, or furniture). Do not remove anything from the Vacation rental unless it is designed to be used outside of the Vacation Rental (i.e. beach towels and strollers) and all items must be returned to the Vacation Rental after off-site use in their original condition.

This is a NON-SMOKING/VAPING home: NO SMOKING or VAPING of ANY KIND is allowed inside the property or in the front yard. This means inside the house or on the property in front of the home.  We do permit smoking in the rear yard as long as Guest agrees to properly extinguish and discard their cigarette butts in the trash at all times and your smoking doesn’t make the inside of the home smell. We recommend staying 5-10 feet away from open doors & windows and neighboring properties. Non-compliance by Guests will immediately result in termination of this Agreement, eviction, and Guest will be responsible for all costs to remove the smoking odor from within Vacation Rental, and any other damages incurred. A fine of $1,000 will also be strictly enforced.  If there is evidence of smoking, vaping, burning incense, etc. is found during or after your stay, you will incur additional charges to repair smoke damage/remove smoke odors, residues, etc. from home.

POOL & SPA: ADULT SUPERVISION (18+) is REQUIRED at all times. There is NO LIFEGUARD ON DUTY! (IF you house has a pool or pool features listed below)

Children are not allowed in the pool/spa area without adult supervision. The Guest/Renter must designate an Adult member of their party to act as a lifeguard while people are swimming, someone who will monitor the pool and spa areas to ensure everyone’s safety. Prohibited activities include running around the pool, diving, jumping in the jacuzzi, and leaving unattended children under the age of 18 in the pool/hot tub. Use of the hot tub carries certain health risks, and guests use it at their own risk. All non-swimming children MUST wear a life vest while in the pool area (Even if they are not swimming). Children who are not potty trained must use a swim diaper in the swimming pool and spa at all times. If feces are found in the pool the renter will be charged a fee for draining, cleaning and refilling the pool or spa. The pool is secured by dead-bolt locks on all doors leading to the pool, which also have child safety alarms.  Renter acknowledges there is no child-security fence surrounding the pool. The renter will receive the home with all exterior gates/doors locked. It is the renter’s responsibility to ensure the safety of their children if they choose to unlock gates/doors, and they will hold the Owner/Property Manager/Management Staff harmless in the event of an accident. (Pool & backyard hours are from 9 am – 10 pm – NO noise between 10 pm and 9 am)             

                                                                                             

Our pools are professionally cleaned and serviced twice a week. A net is provided on the side yard to allow guests to remove any leaves or debris from the surface of the pool between cleanings. It is important to note that the presence of a few leaves in the pool during your stay does not constitute a “dirty pool.” On occasion, this area may experience high winds that result in significant debris being blown into our pools. Once the high winds subside, our pool company will promptly clean the pool. If you have paid for pool heating, the pool will automatically be heated for you.  We utilize remote control devices that inform us of the current pool temperature and settings. Should you require any assistance regarding the pool, please contact either LaDonna, Carolyn, or Nadave. Changing the settings on your own is considered tampering with the pool equipment. *Tampering with pool heater or pool equipment will result in a $500 fine being imposed on guest. There is absolutely NO climbing on the pool rocks and grotto area and NO jumping/diving from the waterfall ledge over the grotto or from rocks, these actions are strictly prohibited.  The area of the pool below these areas is shallow, and jumping into the pool from these heights could result in serious injury. The built-in pool slide is slippery and should be used with care in a sitting position.  Under NO circumstances is sliding backwards permitted. These activities are potentially dangerous, and we will not be held responsible for any injuries arising from such actions. It is your responsibility to ensure that all of your guests are aware of and comply with these rules for their safety.  Use of any flotation devices/pool toys (not provided, however, some guests leave them behind for others to enjoy) is at your own risk and Guest (or otherwise) agrees to hold (our company name provided after booking), it’s representatives, property managers, owner(s)/entity(s)harmless under any circumstance(s).   

Standard Pool heating is 82 and Jacuzzi heats to 102 (Included in Reservation Pricing).          

                                                                                                                                                                                     

GARDENER & POOL COMPANY (If you house has a pool or yard) come during the week and have keys to side gates, they usually come between 8am & 6pm 

Shipping/Deliveries: We do not offer shipping/delivery assistance via USPS (won’t deliver to house), FedEx, UPS, Amazon, a local grocer, or any other carrier. Should you choose to schedule a delivery to the Vacation Rental during your stay, we cannot be held responsible for logistical issues, delays, undelivered, or missing packages. Shipping via FedEx, UPS or by any other means is at your own risk and is not permitted outside of the dates of your stay.

Media/Event Use Restriction: The Vacation Rental may not be used or reproduced for, or as part of, any social media, online listing, photographic production, television production, movie/film production, wedding event, party, commercial activity, or in any other way in which our home becomes a setting for amateur or professional use, producing, or staging without prior written consent from (our company name provided after booking). Any unauthorized commercial use or media production will result in immediate termination of the rental agreement and forfeiture of all payments. Adult film productions are strictly prohibited.

Samsung Refrigerator: This refrigerator has a special auto fill pitcher, if it is lost or damaged the replacement cost is $200 and the Ice scoop is $25. Please make sure they are returned to their place inside the refrigerator.

Cleaning Standards: Our homes consistently meet and exceed industry cleaning standards. We have numerous reviews each year praising the cleanliness and quality of our homes. With that said, if you go searching every
nook and cranny of the home expecting to find a surgically clean environment, this is beyond a reasonable expectation. If you arrive to a home and feel the home is not acceptably cleaned, please contact us immediately for resolution.  We will send over a manager to evaluate and address your concerns.

Outdoor Security Camera(s): Security cameras are installed on the exterior of the property solely to ensure compliance with city-mandated rules. Cameras only record exterior areas. These cameras are not actively monitored; however, they do send electronic notifications to (our company name provided after booking) personnel for potential follow-up with Guests if the cameras detect activity between 10:00 p.m. and 9:00 a.m., in accordance with (city you are booking in) city mandated Quiet Time Hours/Ordinance. The cameras may also monitor parking compliance, including but not limited to: Ensuring that no vehicles encroach upon or park over the sidewalk in any manner. Ensuring that no vehicles are illegally parked on the street. Guests are prohibited from covering or tampering with security cameras or noise monitoring equipment. Please be advised that the use of the property and all its amenities is undertaken at your own risk, regardless of the presence of security cameras.

Timely Communication and Methods: The Guest agrees to communicate in a timely manner before, during, and after their stay, and to notify (our company name provided after booking) immediately regarding any questions, concerns, issues, accidents, or emergencies related to the Vacation Rental. This enables (our company name provided after booking) to provide a five-star experience. (our company name provided after booking) may communicate with Guests via phone, text, email, mobile apps, social media platforms, etc. (our company name provided after booking) requires a primary phone number and email, as well as two alternate phone numbers and emails, to ensure timely contact with Guests during their stay.

Utilities, Internet, TV Usage: Anaheim Vacation House provides electricity, gas, hot and cold water, and trash collection services. Wireless internet access is also provided. The use of the internet to access illegal content or to commit any cyber-crime is strictly prohibited and will be reported to local authorities in accordance with applicable laws. Guests are not allowed to purchase any ON DEMAND entertainment, or downloadable or streaming content at (our company name provided after booking) expense. The company is not responsible for service provider outages, as these issues are beyond our control, and no refunds will be issued as a result.

Housekeeping and Supplies: A one-time setup of linens, towels, soaps (unlimited hand, dish, laundry), and basic paper products (2 rolls Toilet Paper per bathroom, 2 Rolls Paper Towels, 2 Kitchen and 2 Exterior Trash bags) and Unlimited Shampoo & Conditioner are provided for Guests’ convenience, however daily maid service is not provided. (our company name provided after booking) reserves the right to charge additional fees for excessive cleaning, laundry, and for ruined textiles and linens (i.e. stained towels or bleached sheets) or missing items.

Entering Vacation Rental: (our company name provided after booking) may enter Vacation Rental including but not limited to: in the event of an emergency or relevant concern, to make necessary repairs, or for supplying necessary or agreed upon services. Except in cases of emergency entry or relevant concern, entry will be made during normal business hours.

Things Break: We cannot guarantee that everything in the house will work 100% of the time, but if there is a problem, CALL US IMMEDIATELY and we will do our best to rectify any problems in a timely manner. No refunds will be given for failure of household items/appliances/plumbing/electric/heating/air, etc. If you have paid a pool/spa heating fee and it does not appear to be heated, call us immediately so we can check it out. No pool heating refunds will be issued if we are not notified first, and we will only refund the pool fee in these cases.

Fireworks: Fireworks are not allowed at our property.  They are prohibited on the property, prohibited on the street and prohibited in the neighborhood.

Pest Control: All homes receive regular monthly pest control service. This does not guarantee the absence of spiders, bugs, ants, etc., but ensures the homes are as bug-free as possible. Bugs, including ants and gnats, may enter the home, especially if food is not properly cleaned up and stored. This area also has small outdoor mosquitoes that bite in the evenings and can enter when doors are opened and closed. So please be sure to keep all doors and windows closed. Bed bugs are extremely rare in these homes. However, if an inspection for bed bugs is required due to a complaint, the guest will be responsible for the inspection fee if no bed bugs are found, and the pest control company certifies the house as bed bug-free.

The pest control company offers complimentary service anytime between regular service, as needed. Guests need to contact us for assistance. Guests are responsible for any pests they allow to enter the home. No refunds or compensation will be provided for bites to guests or their visitors.

Policies for Complaints: If you arrive and find an issue with our home (or if one occurs during your stay), please call Carolyn, Nadave or LaDonna immediately.  We have the right to have our staff remedy the situation within 24 hours of notification of issue and no compensation will be offered for items not reported or remedied with 24 hours of notice.

General Provisions:  The manager is not the owner of the Unit(s) providing lodging accommodations to Guest. While the manager takes reasonable precautions to maintain safe premises, the manager cannot be held liable for injury to persons or property, or theft of money, jewelry or other valuables, except where caused by the manager’s gross negligence or willful misconduct.  (our company name provided after booking), it’s employees, or contractors are not responsible for lost or items left behind. We will make the best effort to find reported items that were left behind from your stay. You and your guests are responsible for your belongings. It is the responsibility of the renter to pay for shipment and associated costs of any found items. 

7. THIRD PARTY BOOKING and SUBLETTING: Third parties (i.e. travel agents) are required to disclose their position at time of reservation. (our company name provided after booking) contracts directly with Guests and not third parties. Guests may not sublet or assign this Agreement or the Vacation Rental in part or full.

8. GUEST(S) LIABILITY: Guests are jointly and severally liable for all rent and other charges incurred during the term of this agreement, and for all damage to the Vacation Rental caused by themselves or unauthorized individuals. Each Guest may be held fully liable for the act(s) or omissions of the other Guest(s) in accordance with the provisions of this agreement. 

9. ASSIGNMENT: (our company name provided after booking) may assign this Agreement or any of its rights, or delegate any of its duties under this Agreement, at any time provided that such assignment or delegation does not materially impair Guest’s rights under this Agreement. Guest will be provided written notice of any such assignment

10. LEGAL FEES, CHARGEBACKS, SMALL CLAIMS COURT, ARBITRATION, and JURISDICTION: In the event of any controversy, claim or dispute relating to this Agreement or any breach thereof, the parties agree to pay their attorney’s fees and costs. In the event of a dispute including through credit card companies, the parties agree that claims within small claims court jurisdictional limits shall be filed there, and all other claims shall be submitted to binding arbitration under the review of an independent arbitrator. This Agreement shall be governed by, enforced and construed in accordance with the laws of the State of California. If any term, provision or condition contained in this Agreement (or the application of any such term, provision or condition) shall to any extent be invalid or unenforceable, the remainder of this Agreement shall be valid and enforceable to the fullest extent permitted by law. In all cases the language in all parts of this Agreement shall be construed simply, according to its fair meaning under California Law. In the event any dispute arises between the parties, the parties agree that the venue or the given dispute shall exclusively be Orange County, California. The parties agree that this is a mandatory forum and venue selection clause.

11. CLASS ACTION and JURY TRIAL WAIVER: The parties agree that any dispute resolution proceedings will be conducted only on an individual basis (as outlined in Section 10 above) and not in a class, consolidated or representative action. If for any reason a claim proceeds in court, the parties waive any right to a jury trial.

12. GUEST(S) INDEMNIFICATION: The Guest(s) hereby agrees to indemnify (our company name provided after booking)  and property owner(s) and/or property lessee against losses arising from Guest’s negligence or willful misconduct, or that of Guest’s invitees. The Guest(s) hereby agrees to hold (our company name provided after booking) and property owner(s) and/or property lessee harmless in all such matters including personal accidents and/or personal injury of any kind to any party (Guest or otherwise) including all areas and amenities of the property including but in no way limited to any pool or spa or bunk bed(s), unless such injury or damage is committed deliberately by (our company name provided after booking).

13. (Company Name Given after booking) LIMIT of LIABILITY: 

(our company name provided after booking) and related parties shall not be liable except for damages caused by their gross negligence or willful misconduct. Guests or (un)authorized individuals hold the aforementioned individuals and entities harmless for any injury or illness, accidental, personal, bodily, or otherwise, to any Guest or unauthorized individual of Guest or any person located on the premises of the Vacation Rental. This also applies while using any provided onsite/offsite amenities, including but not limited to: Bunk beds (adults not allowed on top bunks), BBQ, Pool and spa and equipment areas/storage, Pool toys, Playground facilities, Beach toys, Boogie boards, etc. Furthermore, (our company name provided after booking) shall not be liable for the loss of, or damage to, any article belonging to Guest or (un)authorized individual of Guest, or any person located in said Vacation Rental, or any other Vacation Rental under the control of (our company name provided after booking). We are also not responsible for 3rd party data breaches, this includes but is not limited to your booking platform, partner integrations used to provide guest experiences, etc.)

14. INSURANCE: It is understood by Guest(s) and all parties that Guest’s personal effects are NOT insured by (our company name provided after booking). Guest is required to maintain their own insurance coverage for personal property and liability during their stay. Guest acknowledges that failure to maintain appropriate insurance coverage is at their own risk. (our company name provided after booking) does NOT insure Guest for any personal injury or property damage including that caused by the act or omission of any other Guest or third party or by any criminal act or activity, war, riot, insurrection, fire, water, roof leaks, electrical or gas utilities, or act of God. Guests shall obtain and pay for any insurance coverage that Guest(s) deem(s) necessary to protect Guest(s) from any loss or expense that may be caused by such persons or events. Again, (our company name provided after booking) strongly recommends Guests purchase appropriate travel insurance.

15. ENTIRE AGREEMENT: The foregoing constitutes the entire agreement between the parties and supersedes any oral or written representations or agreements that may have been made by either party. You may not make changes or modifications to this agreement. (our company name provided after booking) reserves the right to assign the Guests’ reservation. The Guest also represents that they have relied solely on his/her own judgment and expertise in entering into this Agreement with (our company name provided after booking). Guest acknowledges they have read, understand, and will abide by this Agreement, the (city you are booking in) Ordinance for Short Term Rentals, both General and Property Specific (our company name provided after booking) – Vacation Rental Rules, and all Community Association (HOA) Rules and Regulations and that all rules are deemed covenants of this Agreement, and that any violation of any of these rules and regulations shall constitute a breach of the Agreement.  **Please bring this completed rental agreement with you. The city requires you to have it on the premises with you at all times** The signing Guest agrees that their electronic signature during the reservation process, and/or physical signature herein, binds this agreement to all guests.

 

 

The renter must inform all their visitors and guests of the rules and provisions of this agreement. 

The renter is responsible for ensuring their visitors and guests adhere to the rules  and is wholly responsible for any damages.
